Truck manufacturer Navistar has asked the US Court of Appeals, District of Colombia Circuit, to review the US EPA's decision to advocate SCR as a 2010 emission-control strategy for heavy-duty vehicles. Navistar filed a petition on 31 March 2009 and on 4 May submitted a statement of issues for the court's review. Amongst other issues, Navistar questions the legitimacy of the EPA's 2009 guidance document which promotes SCR, when in 2001 the agency stated that SCR was not a feasible technology option. Navistar maintains that this policy U-turn has not been subjected to a credible review process. The Court's decision may have serious implications for the post-2010 Class-8 market, as well as, the fledging DEF market.
